Terms of Use
PLEASE READ THESE TERMS CAREFULLY. By accessing or using RosettaMaps (the "Service"), operated by RosettaMaps ("we," "us," "our"), you agree to be bound by these Terms of Use ("Terms").
1. Acceptance of Terms
By creating an account or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Responsibility Pact. If you do not agree, do not use the Service.
2. Your Responsibility for Camping Legality and Safety
This is the most important section of these Terms.
- We do not guarantee the accuracy, legality, or current availability of any spot listed on the Service, whether community-submitted or sourced from public data
- Land ownership, access rights, and camping regulations change and may not be reflected in real time
- You are solely responsible for verifying that any location is legally accessible and safe before camping, parking, or staying there, including checking current regulations with the relevant land management agency
- We are not responsible for any fines, towing, citations, property damage, injury, or other consequences resulting from your reliance on information found on the Service
By using the Service, you agree to exercise independent judgment and comply with all applicable laws and regulations.
3. Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. User Submissions and Content License
When you submit a spot, report, photo, or other content ("User Submissions"), you represent that you have the right to submit it and that it complies with our Responsibility Pact.
By submitting content, you grant RosettaMaps a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your User Submissions in connection with operating and promoting the Service. You retain ownership of your content, but understand that:
- Original spot submissions are immutable once posted and cannot be edited by you after submission, though you may add subsequent reports/updates
- Your content remains visible to other users and on the platform's shared dataset even if you delete your account, as it forms part of the community resource other users rely on
- We may remove, edit, or restrict visibility of any User Submission at our discretion, including for violations of the Responsibility Pact or these Terms
5. RosettaMaps Content and Database
Except for User Submissions, third-party content, and public or open-source data identified as such, the Service—including its software, design, presentation, organization, selection, coordination, compilation, and arrangement of content—is owned by or licensed to RosettaMaps and is protected by applicable intellectual-property and other laws.
Subject to these Terms, RosettaMaps grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Service for its intended purpose. No ownership rights are transferred to you.
6. Prohibited Conduct
You agree not to:
- Submit spots at locations you know are not legally accessible for camping (private property, business premises without permission, residential areas, prohibited rest areas, etc.)
- Submit false, fraudulent, or duplicate spot listings
- Harass, threaten, or abuse other users
- Access, search, crawl, scrape, copy, capture, download, extract, collect, index, cache, monitor, or otherwise obtain any content or data from the Service—including locations, coordinates, map data, listings, reports, photographs, descriptions, ratings, metadata, or user information—by automated means or through systematic manual activity, except through functionality expressly provided by RosettaMaps for that purpose. Prohibited means include bots, spiders, crawlers, scripts, browser automation, scraping tools, data-mining tools, and unauthorized access to APIs or other application interfaces
- Download, copy, aggregate, reproduce, republish, sell, license, distribute, display, or otherwise exploit any substantial portion of the Service or its content, or repeatedly extract smaller portions for the purpose of reconstructing or compiling a collection, directory, map, database, or dataset
- Use content or data obtained from the Service to create, populate, improve, validate, or support a competing product or service
- Use any content or data from the Service to train, fine-tune, test, evaluate, or provide retrieval context for an artificial-intelligence or machine-learning system without our prior written permission
- Circumvent rate limits, access controls, technical safeguards, paywalls, robots directives, moderation systems, or other measures intended to prevent or limit access to or extraction of content
- Access or use any non-public API, endpoint, feed, or other interface without our express written authorization
- Upload content that infringes the intellectual property rights of others
- Use the Service for any unlawful purpose
7. Moderation, Suspension, and Termination
We maintain a moderation system to enforce these Terms and the Responsibility Pact.
- Suspension: Your account may be temporarily suspended, with content preserved, pending review or correction of the issue.
- Ban: Your account and associated content may be permanently removed for serious or repeated violations, and your email address may be blocked from creating future accounts.
We reserve the right to take these actions at our discretion, with or without prior notice, where we believe it necessary to protect the integrity of the Service or its users.
8. Subscriptions and Billing
Eligible accounts may activate one seven-day Pro trial. No payment method is required, the trial does not renew automatically, and no charge is made when it ends. Trial eligibility is limited to one trial per account and may be unavailable to accounts that previously held a paid Pro subscription.
Certain features require a paid subscription ("Pro"). Where subscriptions are available, by subscribing you agree to:
- Pay all applicable fees as described at the time of purchase
- Automatic renewal at the end of each billing cycle unless cancelled prior to renewal
- Billing processed securely through our payment processor
- Fees are non-refundable except as required by law or as we may decide at our discretion
We may change subscription pricing with reasonable advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
9. Free Tier and Advertising
Free accounts may access certain features supported by advertising. We do not control the specific content of third-party advertisements displayed on the Service. Advertising is not currently active on the Service as of the date of these Terms, but this section applies once it is introduced.
10. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROSETTAMAPS AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO RELIANCE ON ANY SPOT INFORMATION.
12. Indemnification
You agree to indemnify and hold harmless RosettaMaps from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Submissions, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
